Terms of Service

1. About
The LiveSend service (the “Service”) is operated by Nanoscale Studio, sole proprietorship registered in France (see Legal Notice for full details).
The Service lets you host an HTML document, obtain a stable public URL to share it, and view consultation analytics.
2. Acceptance
Creating an account on LiveSend constitutes full acceptance of these Terms. If you do not agree, do not use the Service.
3. Account
You sign up with a valid email address. Authentication is via magic link or password. You agree to provide accurate information and to keep your credentials confidential.
Your username is generated from the first/last name provided during onboarding and cannot be changed afterwards.
4. Plans and pricing
The Service offers two plans:
- Free: up to 3 documents, 7-day analytics, “Shared with LiveSend” watermark on the public viewer.
- Pro: unlimited documents, password protection, expiration, custom URLs, inline editing, 90-day analytics, no watermark. $15/month or $12/month billed annually ($144/year).
Payments are processed by Stripe Payments Europe Ltd (Ireland). We do not store any card data. As a French micro-enterprise, the publisher applies the VAT base exemption (Article 293 B of the French Tax Code) — VAT is not applicable. Prices are in USD; your bank or card issuer may apply currency conversion if you pay in another currency.
5. Ownership of uploaded content
You retain all rights to the HTML content you upload. You grant Nanoscale Studio a non-exclusive, royalty-free, worldwide license, limited to the duration of your account, to store, display and deliver this content solely for the purpose of operating the Service.
You warrant that you have all rights necessary to upload the content and that it does not infringe any third-party rights (copyright, trademarks, privacy, etc.).
6. Prohibited content
You agree not to upload:
- unlawful, defamatory, abusive, hateful or discriminatory content;
- pornographic content, child sexual abuse material, or content exploiting minors;
- malicious code (malware, attack scripts, phishing, cryptominers);
- content infringing third-party intellectual property;
- personal data of third parties without a legal basis.
Nanoscale Studio reserves the right to suspend or delete, without prior notice, any account or content in violation. No refund will be due in such cases.
7. Right of withdrawal (EU consumers)
In accordance with EU consumer law (Article L221-18 of the French Consumer Code), if you are a consumer based in the European Union, you have 14 days from subscription to withdraw from the Pro plan. To exercise this right, email us at contact@nanoscale-studio.com.
By subscribing, you may expressly waive this right to access Pro features immediately — in which case, pursuant to Article L221-25, no refund will be due for the subscription period already consumed.
8. Cancellation
You may cancel your Pro subscription at any time from Settings (link to the Stripe customer portal). Cancellation takes effect at the end of the paid period. Pro-rata refunds are not granted.
You may delete your account by contacting contact@nanoscale-studio.com. Deletion results in the permanent erasure of your documents, versions, views and settings within 30 days.
9. Availability
The Service is provided “as is” and “as available”, without warranty of continuous availability. Nanoscale Studio may interrupt the Service for maintenance, updates or force majeure events. We are not liable for any temporary unavailability.
10. Limitation of liability
To the maximum extent permitted by applicable law, Nanoscale Studio shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, reputation or business opportunities.
In any event, our aggregate liability arising out of or relating to the Service shall not exceed the greater of (i) the amount you paid us in the twelve (12) months preceding the claim, or (ii) €100.
You acknowledge that LiveSend is not a backup solution and that you are responsible for keeping local copies of the content you publish.
Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot be excluded under applicable law (in particular consumer-protection mandatory provisions in your country of residence if you are an EU consumer).
11. Changes to these Terms
We may update these Terms at any time. Users will be notified by email at least 15 days before any material change takes effect. Continued use of the Service after that date constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by French law. Any dispute shall first be addressed through good-faith negotiation. Failing amicable resolution, the courts of Marseille (France) shall have exclusive jurisdiction, subject to the mandatory consumer-protection rules of your country of residence if you are an EU consumer.
EU consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
13. Users outside the EU
The Service is provided from France. If you access it from another jurisdiction, you are responsible for compliance with your local laws. To the extent permitted by law, you accept that your relationship with Nanoscale Studio is governed by these Terms and by French law as set out above.
